A rental agreement is a contract between you and your landlord that establishes your rights to be in a rented apartment. If your landlord dies or changes, the new owner will have to comply with the terms of your rental agreement. They must follow the correct procedure if they want to terminate the lease, see the section on evacuation for more information. If a landlord has used another type of lease, he must give these notes to his tenant: if you are a private tenant, you probably have a short secure lease or a secure lease. You have certain legal rights, even if you don`t have a written lease. Check your rental type if you are not sure what type of rental you have. The lease offers security, stability and predictability for tenants and reasonable guarantees for landlords, lenders and investors. The new legal requirements for landlords and tenants are contained in the Private Housing (Tenancies) (Scotland) Act 2016. If you are moving into a privately rented property, your landlord must ask you to sign a rental agreement that outlines the terms of your stay.

It will usually be a written document, but it may also be an oral agreement. If you don`t have a written agreement, you still have rights as a tenant. The leases page contains more information about what a fair lease should contain. If the lease cannot be passed on, the landlord may be willing to enter into a new lease with someone who lived in the house. If you are unable to reach an agreement with your landlord, you must wait until the term of your lease expires, as you are still liable for your rental until that date. Read the common law page on tenant rights to learn more. By law, a landlord must communicate in writing to a tenant all rental conditions. Our Scottish Private Residential Tenancy Agreement model can be used for this purpose. Our online model of private rental contracts is easy to use and helps an owner create a rental contract by filling out the details in an online form.

Short leases are the most commonly used type of rental in the PRS. They must be properly set up and last at least 6 months. Most common law tenants can terminate their leases before the term of the tenancy agreement expires. In your rental agreement, you may have to cancel four weeks in advance if you want to move or your landlord will have to inform you four weeks in advance if they want you to leave.
